Relief for Small Dairies as Oregon Department of Agriculture Walks Back Expensive New Mandates

Small dairy farmers’ federal lawsuit with Institute for Justice will continue.

The Oregon Department of Agriculture informed small dairy farmers that it has withdrawn a policy that would have subjected farms milking only a handful of animals to expensive regulations designed for massive dairies. However, since the withdrawal is only temporary and the department is not conceding that it lacked the power to enforce the new requirements, a lawsuit filed by four dairies represented by the Institute for Justice (IJ) will continue in federal court.

Oregon, like many states, has requirements for dairies that operate CAFOs, confined animal feeding operations. Last year, at the prompting of large dairies, the department demanded that small dairies install expensive and complicated drainage and holding systems. Under the newly reinterpreted regulations, to continue milking, Sarah would need to install a wastewater infrastructure and a holding tank, keep daily records, and pay annual permit fees. This could add up to tens or hundreds of thousands of dollars. And all of it, according to the state, to supposedly manage wastewater that farms like Sarah’s don’t really produce. The state was set to begin enforcement on April 1 before announcing its about-face in the wake of IJ’s lawsuit.

Small dairy farmers sue Oregon government over new regulations

A group of four dairy farmers is suing the Oregon Department of Agriculture over a new policy that they say will threaten their small businesses.

Starting April 1, some small dairies will need to register as Confined Animal Feeding Operations, or they could face fines. That process includes creating a plan for wastewater management.

In a memo last year, the ODA said some raw milk producers were ignoring the registration requirement. The agency said this has created environmental concerns, and other dairies had complained about unfair competition.

Now, some farmers are pushing back. On Jan. 24, they filed a complaint in federal court, arguing that the requirements don’t reflect how small businesses operate. And they accused the state of protecting the corporate milk industry. The lawsuit was first reported by the Statesman Journal.

"These farms are not in competition," Bobbi Taylor, a lawyer for the plaintiffs, told KLCC. "They sell a different product. Their customers seek them out, because they're a small farm, they sell raw milk, their operation is sustainable, and their customers prefer to buy small."

In an email, the ODA declined to comment or provide further information about its policies.

Colon cancer on the rise in young adults: GMOs, vaccines and synthetic folic acid all to blame 02/20/2024 / By Ethan Huff

Ever since the 1990s, colon cancer rates among young people under the age of 50 have skyrocketed, and the establishment is pretending not to know why.

Poor diet, they admit, is probably linked as genetically modified organisms (GMOs) were first introduced right around the time colon cancer started becoming a serious problem in young people. Other dietary factors linked to colon cancer include processed, highly inflammatory foods and alcohol.

The American Cancer Society (ACS) published a report recently about the phenomenon, which is further explained by another study published in the journal Cancer Research Communications that once again points to dietary factors, and particularly the consumption of synthetic folic acid.
